THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.13644 OF 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 1 to 3 in toeing the respondents 4 & 5 by intruding into the Petitioner's privacy and disturbing him in violation of Articles 21 & 300-A of Constitution of India."

I have heard the submissions of Sri D.Hanumantha Rao, learned counsel for the petitioner, and of the learned Government Pleader for Home (TG), appearing for the respondents 1 to 3. I have perused the material record.

Learned senior counsel appearing for the petitioner, while reiterating the pleaded case of the petitioner, submits that on account of the matrimonial disputes, the petitioner is being repeatedly called to the police station and is being made to wait in the police station for hours together; and, that he is being harassed and the police are interfering with his life and personal liberty despite the fact that no crime has been registered and his presence is not required before the police as per law. 4.

Learned Government Pleader for Home seeks further time for instructions.

The respondents 1 to 3 have not placed on record any material to show that a crime has been registered against the petitioner.

Having regard to the submissions, the Writ Petition is disposed of directing the respondents 1 to 3 not to call the petitioner to the police station and interfere with his life and personal liberty. However, this order shall not preclude the said police officers in proceeding in accordance with the procedure established by law in the event any crime is registered against the petitioner. There shall be no order as to costs. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
