HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26700 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking writ of Mandamus declaring the action of the 2nd respondent in not disposing the statutory appeal filed by the petitioner, as arbitrary and illegal.

2. Heard learned counsel for the petitioner and learned Standing Counsel for respondent Nos.2 and 3.

3. Petitioner claims that he is owner and possessor of land to an extent of Ac.4-10 guntas situated in survey No.224/AA of Srinivasa Nagar, Jadcherla Grampanchayat, Mahabubnagar District by virtue of registered sale deed. Thereafter, the petitioner converted the said land into house site plots and sold some plots to different persons. However, the 4th respondent, without there being any right over the property of the petitioner, made illegal constructions in the plot of the petitioner pursuant to the permission granted by the 3rd respondent on 27.10.2014. Being aggrieved by the same, the petitioner filed appeal on 21.01.2016 before the 2nd respondent and till date the said appeal is not disposed of.

4. At the time of argument, the only relief sought for by the petitioner is to direct respondent No.2 to dispose of the appeal filed by the petitioner on 21.01.2016. Learned Standing Counsel for respondent Nos.2 and 3 also consented for the same.

5. Having regard to the facts and circumstances of the case, respondent No.2 is hereby directed to dispose of the appeal filed by the petitioner, in accordance with law, as expeditiously as possible, preferably within a period of one month from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous
