THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11569 of 2016 ORDER:

Heard Sri Dadi Radha Krishna, learned counsel for the petitioners, and Smt. Pingali Lakshmi, learned Standing Counsel for the Greater Warangal Municipal Corporation.

The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit it is prayed that this Hon'ble Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in issuing the notice dated 12.11.2015 (served on 15.03.2016) is arbitrary, illegal, without jurisdiction and violation of Art.21 of the constitution of India and consequently direct the respondent not to take any further action without considering the explanation submitted on 21.03.2016 and pass such other order or orders as are deemed fit and proper in the circumstances of the case."

The impugned notice dated 12.11.2015 is in the nature of a show-cause notice and the petitioners admittedly submitted their response thereto vide letter dated 21.03.2016. That being so, no cause is made out for interference by this Court at this stage. The writ petition is accordingly disposed of directing the Greater Warangal Municipal Corporation to take the petitioners' reply dated 21.03.2016 into account and take appropriate action in the matter pursuant to the show-cause notice dated 12.11.2015. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
