THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI WRI T PETI TI ON No.7294 of 2017 ORDER: (per SK,J) This writ petition was filed seeking implementation of the order dated 11.03.2015 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.3854 of 2014. By the said order, the Tribunal directed the authorities to consider the case of the petitioner, the applicant in the said O.A., for promotion to the post of Head Constable by taking the date of expiry of the punishment suffered by him as 16.01.2014 and to pass appropriate orders if he was otherwise found eligible and qualified. This exercise was directed to be completed within eight weeks.
Notice having been ordered, learned Assistant Government Pleader for Services (Telangana) fairly concedes that no writ petition was filed by the authorities challenging the aforestated order. That being so, it is not open to the authorities to fail to implement the order passed by the Tribunal fixing a time frame for compliance. The writ petition is accordingly allowed. The respondents are directed to consider the case of the petitioner for promotion in terms of the order passed by the Tribunal expeditiously and, in any event, not later than four weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
