A.P.S.R.T.C. Employees Thrift And Credit Co-Operative v. The Chairman,
THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.19778 of 2009 ORDER:
Heard Mr. A.K. Jayaprakash Rao for petitioner and Mr. P. Hari Prasad for respondents 2 to 5.
2. APSRTC Employees Thrift and Credit Cooperative Society Limited challenges the order in I.A.No.28 of 2009 in O.P.No.1 of 2009 dated 30.06.2009 as illegal and arbitrary.
3. The Cooperative Tribunal, through the impugned order under writ petition, directed the writ petitioner not to deduct from the salaries of respondents 2 to 5 herein the amount due and payable by late V. Linga Murthy until further orders.
4. Counsel appearing for the parties submit that the OP is still pending.
5. With the assistance of learned counsel for parties, I have perused the order impugned in the writ petition. Instead of going into the merits of the interlocutory order, this Court is of the view that the Cooperative Tribunal, Warangal can be directed to dispose of O.P.No.1 of 2009 within a timeframe.
Hence, the writ petition is disposed of by this order. The Cooperative Tribunal, Warangal, is directed to dispose of O.P.No.1 of 2009 within three (3) months from the date of receipt of a copy of this order. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
