These Criminal Petitions are filed by the petitioners/accused Nos.5, 6 and 9, seeking anticipatory bail under Section 482 of Bharatiya Nagrik Suraksha Sanhita (BNSS), in connection with Crime No.386 of 2025 of Saroornagar Police Station, Rachakonda, registered for the offences punishable under Sections 69 and 108 of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS') and Section 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 2015. 2.
Heard Mr. S.Someshwar Rao, learned counsel for the petitioners and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the respondent/ State. 3.
The case of prosecution is that the de-facto complainant has two children i.e., a daughter named Dharmarapu Mallishwari, a 26year-old Staff Nurse at NIMS Hospital, and a son. Mallishwari had been in a six-year relationship with Jana Reddy, a man from their village, and the family agreed for their marriage. However, six

months ago, Mallishwari revealed that Jana Reddy had refused to marry her, despite their physical relationship. He promised to marry her later but kept delaying. One month ago, Mallishwari informed her mother that Jana Reddy had betrayed her by marrying another woman, citing her Scheduled Caste status as the reason. He also insulted her and warned her not to contact him again. Ten days before the incident, Mallishwari was in her hostel, with the family planning to convince Jana Reddy's family. On 14.04.2025, Mallishwari was found unconscious in the hostel bathroom and was declared dead at Osmania Hospital. Basing on the same, a case was registered in Crime No.386 of 2025.

Learned counsel for the petitioners/accused Nos.5, 6 and 9 submits that the petitioners have not committed any offence and they were falsely implicated in the aforesaid crime. He further submitted that there are no allegations much less specific allegations against the petitioners to attract the ingredients of alleged offences against the petitioners. He further submitted that the petitioners never instigated or provoked the deceased to commit suicide. He further submitted that very same allegations are

leveled against accused No.7 and he approached this Court and field Crl.P.No.5852 of 2025 for grant of anticipatory bail and this Court allowed the said petition and granted anticipatory bail in favour of accused No.7. Hence, the petitioners are also entitled for grant of anticipatory bail. He further submitted that the petitioners are not having any criminal antecedents and they are ready and willing to cooperate with the investigating officer and also abide by the conditions that may be imposed by the Court. 5.
Per Contra, learned Additional Public Prosecutor submits that the petitioners have committed grave offence and the investigation is under progress and if the petitioners/accused Nos.5, 6 and 9 are granted anticipatory bail at this stage, there is every chance of they are influencing the witnesses and interfering with the investigation. 6.
Having considered the rival submissions made by the learned counsel for the parties and on perusal of the record, it reveals that there are no specific allegations leveled against the petitioners/accused Nos.5, 6 and 9 that they instigated the deceased to commit suicide. The entire allegations are leveled against other

accused. The record further reveals that this Court granted anticipatory bail in Crl.P.No.5852 of 2025 in favour of accused No.7, and the very same allegations are leveled against the said accused. Even according to the learned Additional Public Prosecutor, the petitioners are not having any criminal antecedents. 7.
Taking into consideration of the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners/accused Nos.5, 6 and 9 subject to the following conditions:
(i) Petitioners/accused Nos. 5, 6 and 9 are directed to surrender before the Station House Officer, Saroornagar Police Station, on or before 25.06.2025;
(ii) On such surrender, the Station House Officer of Saroornagar Police Station, shall release the petitioners on bail on their executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) each with two sureties for a like sum each to the satisfaction of the said Officer;

(iii) On such release, petitioners/accused Nos. 5, 6 and 9 shall appear before the Station House Officer, Saroornagar Police Station, on every Monday at 11:00 a.m., for a period of eight weeks for the purpose of investigation and thereafter, as and when required for investigation.
(iv) Petitioners/accused Nos. 5, 6 and 9 shall abide by the conditions stipulated under Section 438(2) of the Criminal Procedure Code, 1973/ Section 482 of BNSS and shall cooperate with the investigation officer for conclusion of investigation.

Subject to the above directions, the Criminal Petitions are allowed. No costs.
As a sequel, miscellaneous petitions, pending if any, stand closed.
