HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.15946 OF 2019 ORDER:
This writ petition is filed with the following prayer: "to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent authorities in issuing the notification published in The Eenadu Telugu daily news paper on 14-12-2018 inviting applications for appointment of Regular/Rural Outlet (Petrol Pump) Dealerships at various locations in the State of Telangana wherein a mistake was crept in with regard to Revenue District pertaining to Mannegudem to Kamepally on NH-365A as Khammam instead of Mahabubabad District as being illegal, arbitrary and unjust and consequently direct the respondent authorities to issue fresh notification in so far as the location i.e.
Mannegudem to Kamepally on NH365A is concerned by rectifying the Revenue District as "Mahabubabad" in the place of "Khammam" and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case." When the matter is taken-up, Sri B.Mayur Reddy, learned Standing Counsel for respondent-company submits that the petitioner has alternative remedy under Cl.24 of PSU Oil Marketing Company's Manual for selection of Dealers for Regular and Rural Retail Outlets (for short "Manual").
Learned counsel for the petitioner submits that impugned notification itself is defective, since the location in question falls within the jurisdiction of Mahabubabad District, whereas notification indicates the said location in Khammam District. When the petitioner tried to apply for dealership, his application was not accepted as the petitioner owns land in Mahabubabad District. But however, learned Standing Counsel says even these
objections can be raised before the Grievance Redressal System, as the issue comes within the purview of Grievance Redressal System as envisaged under Clause 24 of the Manual. He also submits that in similar circumstances, this Court disposed of WP.No.16150 of 2019 by its order dated 31.07.2019.
In view of the facts and circumstances of the case, the writ petition is disposed of granting liberty to the petitioner to make his grievance by way of representation to the Divisional Manager/Territorial Manager who dealt with Grievance Redressal System within one week from today and on such application, the said authority is directed to consider the same and till the same is considered, LOI shall not be granted to selected candidates. In case, the petitioner finds favour by the Grievance Redressal System, fresh notification is to be issued with regard to Clause 671 of the impugned notification.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
