The Hon'ble Sri Justice J.Sreenivas Rao Criminal Petition No.6592 of 2025 Order:

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarika Suraksha Sanhita, 2023 (for short, 'BNSS') seeking anticipatory bail to the petitioner/accused No.1 in Crime No.114 of 2025 of Zaheerabad Town Police Station, Sangareddy District, registered for the offences punishable under Sections and 318(4) of Bharatiya Nyaya Sanhitha, 2023 (for short 'BNS').

The case of prosecution in brief is that on 19.04.2025 at about 16:30 hours, the complainant lodged a complaint stating that the petitioner became her friend through snapchat and later they loved each other and on assurance of the petitioner that he would marry the complainant, they developed physical intimacy and on 24.03.2025, petitioner and his family members came to the house of the complainant and scheduled their engagement ceremony for 20.04.2025, but later the petitioner

blocked the complainant's number on his phone and on 10.04.2025, the petitioner's uncle called the complainant's father and stated that the petitioner would not marry the complainant and the engagement cannot be held. Basing on the said complaint, the present crime is registered against the petitioner/accused No.1 and other accused for the aforesaid offences.

Heard Mr. Mohd. Arif, learned counsel for the petitioner/accused No.1 and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent/State. 4.

Learned counsel for the petitioner submitted that the petitioner has not committed any offence and he was falsely implicated in this case and even according to the complaint, the petitioner and complainant are known to each other since more than one year and engagement was scheduled to be held on 20.04.2025 but even prior to that date, the complainant lodged the complaint. He further submits that accused Nos.2 and 3 are none other than the mother and father of the

petitioner and the petitioner and accused Nos.2 and 3 have filed Crl.M.P.No.237 of 2025 on the file of the Court of the learned IV Additional Sessions Judge, Sangareddy, seeking anticipatory bail and vide order dated 30.04.2025, accused Nos.2 and 3 alone were granted anticipatory bail. He further submits that the petitioner is eking out his livelihood by doing petty business and he is not having any criminal antecedents and he be granted anticipatory bail as he is ready and willing to cooperate with the investigation and abide by the conditions as may be imposed by this Court.

On the other hand, learned Additional Public Prosecutor submitted that specific allegations are levelled against the petitioner and the investigation is under progress and at this stage, if the petitioner is granted anticipatory bail, there is every chance of his influencing the witnesses and interfering with the investigation. Hence, he prays to dismiss the criminal petition. 6.

Having considered the rival submissions made by he respective parties and on perusal of the material available on

record, it reveals that the petitioner and complainant are known to each since one year and their engagement function is scheduled to be held on 20.04.2025 and even prior to that date, the complainant lodged the complaint and accused Nos.2 and 3 were already granted anticipatory bail vide order dated 30.04.2025 passed by the learned IV Additional Sessions Judge, Sanga Reddy District, in Crl.M.P.No.237 of 2025. Even according to the learned Additional Public Prosecutor, the petitioner is not having any criminal antecedents. 7.

In view of the same, this Court is inclined to grant anticipatory bail to the petitioner/accused No.1, subject to the following conditions:

i. The petitioner/accused No.1 shall surrender before the Station House Officer, Zaheerabad Town Police Station, Sangareddy District, on or before 30.06.2025, and on such surrender, the said Station House Officer shall release the petitioner/accused No.1 on bail on his executing a personal bond for Rs.30,000/- (Rupees Thirty

Thousand only) with two sureties, for a like sum each.

ii. On such release, petitioner/accused No.1 shall appear before the Station House Officer, Zaheerabad Town Police Station, on every Monday at 11:00 a.m. for a period of six (6) weeks or till filing of the charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. After release, the petitioner/accused No.1 shall not influence the witnesses or interfere with the investigation.

iv. Petitioner/accused No.1 shall abide by the conditions stipulated under Section 482(2) of BNSS and shall cooperate with the Investigating Officer in the investigation.

Accordingly, the Criminal Petition is allowed. As a sequel, miscellaneous petitions, pending if any, stand closed.
