THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.14944 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:

"To issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents 3 to 5 in permitting irregularities to be committed in the matter of identification of beneficiaries under the NTR Rural Housing Programme, in relation to the layout situated in R.S.Nos.34/1 and 34/2, covering an extent of Ac.3.66 cents of Venkatapuram village, Mopidevi mandal, Krishna District, A.P., thereby resulting in the petitioner being deprived of being allotted a house site/house under the said scheme, as illegal, arbitrary, violative of Articles 14 and 21 of the Constitution of India, suffers from malice-in-law and consequently set aside the grant of benefit under the said scheme to the Respondents 6 and 7 and direct the Respondents 1 to 5 to re-conduct the exercise of identifying bonafide and genuine beneficiaries thereunder and grant the petitioner a house/house site in the said location".

Heard the learned counsel appearing for the petitioner and learned Government Pleader for Revenue appearing for the Respondents. 3.

When the matter is taken up, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted representations dated 30.1.2017 and 6.3.2017 to the respondents, but no orders have been passed on the said representations and a necessary direction may be issued to the respondents to pass appropriate orders on the said representations, in accordance with law, by fixing some time frame.

Recording the said submission and having regard to the nature of controversy, writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter, directing the respondents to consider and pass appropriate orders on the representations dated 30.1.2017 and 6.3.2017 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
