HON'BLE SRI JUSTICE U.DURGA PRASAD RAO I.A.No.2 of 2018 in Crl.P.No.4632 of 2018 and Crl.P.No.4632 of 2018 COMMON ORDER:

Criminal Petition No.4632 of 2018 is filed by the petitioners/A.1 to A.3 seeking to quash the proceedings against them in PRC No.4 of 2018 on the file of IX Additional Chief Metropolitan Magistrate, Hyderabad, vide Crime No.346/2017 of Narayanaguda PS, Hyderabad City registered for the offence under Section 364 r/w 34 IPC.

2) Brief facts of the complaint are that the complainant and A.1 are couple and they have two minor children. There arose a dispute between them as the complainant suspecting her character, used to beat her. In that regard rift developed. It is alleged that A.1 developed illicit intimacy with A.2 and unable to bear the torture of the complainant, she hatched a plan in conspiracy with A.2 and A.3 to eliminate the complainant. On the night of 07.10.2017, she mixed some sleeping pills in a drink and administered him and when he developed some uneasiness in the midnight, on the pretext of taking him to the hospital, A.1 to A.3 tried to kill him. However, the defacto complainant somehow rescued himself and escaped. 3) While so, petitioners/accused and defacto complainant filed I.A.No.1 of 2018 seeking permission of this Court to compound the offence. By a separate order dated 01.05.2018, this Court granted permission for compounding the offence.

4) Today, parties are present and they are identified by their respective counsel.

5) On enquiry by this Court, the defacto complainant affirmed the contents of the joint memo and submitted that he has no objection for quashing the proceedings against the petitioners/accused. 6) In that view of the matter and as the parties have amicably resolved their disputes at the intervention of elders and the allegations made in the charge sheet will have no repercussion on the society and also following the decision reported in Gian Singh v. State of Punjab and another1, I.A.No.2 of 2018 is allowed and permission is accorded to the parties to compromise the matter and consequently, Crl.P.No.4632 of 2018 is allowed and the proceedings in PRC No.4 of 2018 on the file of IX Additional Chief Metropolitan Magistrate, Hyderabad, vide Crime No.346/2017 of Narayanaguda PS, Hyderabad City, and they are acquitted of the offences for which they have been charged.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
