THE HON'BLE DR.JUSTICE SHAMEEM AKTHER I.A.No.2 OF 2018 IN/AND SECOND APPEAL No.522 OF 2018 COMMON JUDGMENT:

I.A.No.2 of 2018 is filed by the appellant/defendant under Section 151 C.P.C. seeking permission of this Court to withdraw S.A.No.522 of 2018 by recording the contents of compromise and settlement deed, dated 23.06.2018.

Learned counsel for the appellant/defendant submits that the appellant and the respondent/plaintiff have voluntarily compromised the matter amicably by entering into a compromise and settlement deed on 23.06.2018; that the appellant has agreed to withdraw all the civil and criminal proceedings initiated and pending against the respondent, including this Second Appeal; that the appellant agreed to receive a sum of Rs.4,00,000/- (Rupees four lakhs only) from the respondent as full and final compromise settlement amount, after vacating the suit schedule property on or before 05.07.2018 and hence, prays to allow I.A.No.2 of 2018. Accordingly, I.A.No.2 of 2018 is allowed and S.A.No.522 of 2018 is dismissed as withdrawn. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this Second Appeal shall stand closed.
