The case of the petitioners is that they are the absolute owners and possessors of various extents of land in Survey No.44, situated at Yellammagutta, Nizamabad Sivar, Nizamabad District, having purchased the same through registered sale deeds. While so, the respondents have acquired an extent of Ac.2.39 guntas in Survey No.44 of Yellammagutta, Nizamabad Sivar, Nizamabad District for the construction of sewerage plant unit-II at Nizamabad town and an award has been passed vide No.B2/18794/2014, dated 07.05.2016. The grievance of the petitioner is that after acquiring an extent of Ac.2.39 guntas in Survey No.44 the respondents 3 and 4 on 24.06.2016 came to petitioners' land and demarcated the acquired land and fixed the boundaries of acquired land without issuing notice to the petitioners and the adjacent owners.
It is further submitted that the respondents 3 and 4 have fixed the stones excess to the acquired land. Against the said illegal action, the petitioners have made a representation dated 25.06.
the petitioners. Inspite of receiving the said representation, the respondents are trying to interfere with the possession of the petitioners which was not acquired by the respondents. Aggrieved by same, present writ petition is filed.
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.
Since part of the land of the petitioners is acquired and award is passed and since there is dispute with regard to demarcation of boundaries, the 3rd respondent is directed to consider the application of the petitioner dated 25.06.2016 and take necessary action for demarcation and identification of the land acquired from the petitioners as per the award passed in the land acquisition proceedings, by issuing notice to the petitioners, within a period of four weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ______________________________ A.RAJASHEKER REDDY, J 19.04.2017 t k.
