THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25570 OF 2012 ORDER:

The petitioner states that she is the owner and possessor of land of an extent of Acs.3.34 guntas in 1922 of Madikonda Village, having purchased the same under registered document, dated 20.01.2009. Originally, the land was purchased by the vendor's husband and fourth respondent and they partitioned the said lands in the year 1989. Later on, the vendor's husband died in the year 1990. After the death of the husband of the vendor, the vendor got pattadar pass books on 11.01.2009 in respect of the property held by the vendor's husband. After purchase of the said property, the petitioner also got the pattadar pass books from the Tahsildar, Hanamkonda. It is the allegation of the petitioner that the fourth respondent also obtained a pattadar pass book, suppressing the share of the vendor's husband for the total extent of Acs.7.28 guntas (Acs.

8.00 guntas). Challenging the same, the petitioner preferred an Appeal before the second respondent and the second respondent by his order, dated 30.04.2011 allowed the Appeal and cancelled the patta granted in favour of the fourth respondent for an extent of Acs.3.34 guntas in 1922. Challenging the same, the fourth respondent preferred a Revision Petition before the first respondent and the first respondent set aside the order of the second respondent by proceedings dated 07.07.2012 and directed disposal of the Appeal preferred by the fourth respondent by following due process of law. It appears that an Appeal was preferred by the fourth respondent and it was pending in File No.A/510/2010, but without disposing of the said Appeal, the second respondent appears to have disposed of the Appeal preferred by the petitioner on 30.04.

In the circumstances, the writ petition is disposed of directing the second respondent to dispose of the Appeals of the petitioner as well as the fourth respondent after hearing both the parties in accordance with law within a period of three months from the date of receipt of a copy of this order.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
