O R D E R
The 2nd petitioner is Azad Degree College, represented by its Secretary. The grievance of the petitioner - College is that though the Registrar of the 1st respondent - University, vide the impugned order No.998-MR/ H/ 2019-2020/ Acad/ IV-2 dated 18.07.2019, extended provisional affiliation for the academic year 2019-20, placed it under " no admission category". Aggrieved by the same, the present writ petition is filed.
Learned counsel for the petitioner submits that having extended the provisional affiliation for the academic year 2019-20, it is not justifiable to keep the college under 'no admission category'. He submits that if there are deficiencies, petitioner is willing to comply with the same. Therefore, the learned counsel seeks to set aside the impugned order to the extent of placing the college under 'no admission category'. Sri Ch.Jaganadha Rao, learned Standing Counsel appearing for the 1st respondent - University, submits that admissions for the academic year 2019-20 are completed and petitioner has to comply with the conditions specified in the impugned order.
Heard Sri A.Abhishek Reddy, learned Standing Counsel for 2nd respondent, and the learned Assistant Government Pleader for Higher Education for the 3rd respondent.
In this case it is to be seen that on the one hand, the 1st respondent extended the provisional affiliation to the 2nd petitioner - college for the
academic year 2019-20, and on the other hand, in the very same proceedings, without recording any reasons, placed the college under 'no admission category', which in effect would make the affiliation nugatory, and hence liable to be set aside.
Accordingly, to the extent of placing the petitioner - college under 'no admission category' in the impugned order, is set aside and the petitioner is directed to comply with the conditions specified in the impugned order.
Writ petition is accordingly allowed to the extent indicated above. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
