HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15947 of 2019 ORDER:

Heard Sri V.V.Narasimha Rao, learned counsel for the petitioner and the learned Government Pleader for Services-II. With the consent of learned counsel for the respective parties, this Writ Petition is disposed of at the admission stage. This writ petition is filed seeking the following relief :- ".........direct the Respondents to permit the Petitioner for duties as Village Revue Assistant/Village Servant (Sethsindhi) for the village of Wardhannapet by taking into consideration the representation of the Petitioner dated 15.06.2019 and in consequence thereof, to direct the Respondents to regularize the appointment of the Petitioner as Village Revenue Assistant by declaring the action of the Respondents in not doing so is illegal, contrary to law and violation of Article 14 and 16 of Constitution of India, as otherwise, the Petitioner will be put heavy and irreparable loss, by issuing Writ of Mandamus or any other Writ or order or direction and pass such other order................."

It has been contended by the petitioner that he was appointed as Village Servant during November, 2009 on contract basis and tenure of the contract period was extended from time to time. While he was discharging his duties as Village Servant, petitioner met with an accident during November, 2018 and consequently, he could not attend the duties. Later, petitioner had submitted a representation to the respondents on 15.06.2019 requesting the respondents to permit him to join the duty. But so far, the respondents have not passed any orders

on the said representation nor permitted the petitioner to join the duty as Village Servant.

Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner and pass appropriate orders in accordance with law. Learned Government Pleader appearing for the respondents contends that since the representation submitted by the petitioner on 15.06.2019 is pending with the respondents, the respondents would consider the same and pass appropriate orders in accordance with law. This Court, having considered the rival submissions of the learned counsel appearing for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 15.06.2019 and pass appropriate orders in accordance with the law, within a period of eight weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
