THE HONOURABLE SRI JUSTICE NARSING RAO NANDIKONDA CRIMINAL PETITION No.6606 OF 2025 O R D E R:

This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner-accused No.1, seeking bail in Crime No.28 of 2025 of Arvapalli Police Station, Suryapet District, registered for the offences punishable under Sections 109, 329(4), 118(1), 324(4) and 132 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS'). 2.

Heard learned counsel for the petitioner and Mr.V.Jithender Rao, learned Assistant Public Prosecutor appearing for the respondent-State. Perused the record. 3.

Learned counsel for the petitioner submits that the petitioner is innocent of the alleged offence, that he has not committed any such act, and that no injuries were sustained by the victim. It is further contended that the petitioner has been in judicial custody since 09.03.2025. 4.

On the other hand, learned Assistant Public Prosecutor, on instructions, submits that the petitioner is already involved in three cases, and if the petitioner is

released on bail, he may threaten the complainant with dire consequences and may try to tamper with the evidence. It is also stated that the petitioner attempted to kill the complainant by sinking her head into a water tub, causing her to suffer injuries.

Having heard the learned counsel on both sides and upon perusal of the material on record, it is observed that the petitioner has been in judicial custody since 09.03.2025, i.e., for more than 75 days. It appears that the prosecution has already examined all the material witnesses, and the material part of the investigation has been concluded. In view of the same, further continuation of the petitioner in judicial custody may not be necessary. Accordingly, the petitioner is entitled to be enlarged on bail, subject to the following conditions:

(i) The petitioner-accused shall be released on bail on executing a personal bond for a sum of Rs.25,000/-(Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the "Judicial First Class Magistrate at Thungathurthy".

(ii) After release, the petitioner-accused shall appear before the concerned S.H.O.

in

between 11.00 a.m. to 2.00 p.m. on first and third Sunday of every month for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioner-accused shall not influence any of the prosecution witnesses in any manner and shall not visit the place of the de facto complainant or victim.

(iv) After release, if the petitioner/accused is indulges in similar offence, the respondentState is entitled to file an application seeking cancellation of the bail granted by this Court in his favour.

(v) The petitioner-accused shall abide by the other conditions stipulated in Section 480(3) of BNSS and shall co-operate with the investigation.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications pending, if any, shall stand closed.
