HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27003 OF 2009 ORDER:
This petition is filed for a writ of Mandamus declaring the action of the respondents in including the names of dead persons and ineligible persons and showing the names of some of the voters of 9th ward in different other wards in the list of voters prepared for conducting election to the 9th ward of Nangegedda Village, Nayanalanka Mandal, Krishna District, as illegal and arbitrary and for a consequential direction to the respondents to delete the names of dead and ineligible persons and show the names of eligible voters of 9th ward alone in the voters list of 9th ward.
In the para-wise remarks submitted by the learned Assistant Government Pleader for Panchayat Raj it is stated that the petitioner should have filed the objections before the Tahsildar who is the Electoral Registration Officer, instead of Mandal Parishat Development Officer who is the 6th respondent herein. Heard.
The subject matter of the writ petition pertains to the elections conducted in the year 2009. In view of afflux of time the cause in the writ petition does not survive for adjudication. Accordingly, the writ petition is dismissed as infructuous. However, it is open for the petitioner to bring his objections to the notice of the Electoral Registration Officer. As and when objections are filed, the Electoral Registration Officer may consider the same and take action in accordance with law. No
order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
