THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.12518 of 2013 Order:

This Writ Petition is filed to declare the action of the respondents in trying to dispossess the petitioner from the lands in Survey No.262/1 to an extent of Ac.9-80 cents, Survey No.174 to an extent of Ac.5-31 cents and in Survey No.262/1 to an extent of Ac.8-65 cents of Peddamudiyam village and Mandal, Kadapa district, without following the due process of law and without serving any notice, as illegal and arbitrary. The case of the petitioner is that the second respondent issued proceedings dated 22.10.2010 approving the lease of lands in his favour for the years 2010-11 to 2012-13 and that due to natural calamities he sustained loss, hence he made a representation to the respondents and without considering the same and without issuing any notice, the respondents are trying to dispossess him and pressurizing to hand over the possession of the lands.

The Writ Petition is that of the year 2013 and there is no interim order in favour of the petitioner. Further, since the period of lease has already elapsed, nothing survives for adjudication in the Writ Petition and the matter has become infructuous.

Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
