THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21700 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer:

"...to issue a writ, order or direction more particularly one in the nature of mandamus declaring the action of the 4th respondent in summoning the petitioner and his family members to the Police Station and making them to sit there for hours together and insisting them to issue a letter to the effect that there is no encroachments in Vaddegiri Street of A.Gokulapadu Village, Kalluru Mandal, Kurnool District and also exerting pressure on the petitioner and his family members to settle and compromise F.I.R. No.12 of 2016 dated 19.4.2016 and also F.R. No.11 of 2016 dated 19.4.2016 on the file of K.Nagulapuram Police Station as illegal, arbitrary, without jurisdiction and violation of Articles 14 and 21 of the Constitution of India and consequently direct the 4th respondent not to interfere with the life and personal liberty of the petitioner and his family members and pass..."

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for respondents 1 to 4. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this Court is not deciding the case on merits, it may not be necessary to hear respondent No.5.

3. It is the case of the petitioner that there is a case

and counter case vide crime Nos. 11 of 2016 and 12 of 2016 of K.Nagalapuram police station, K.Nagalapuram, Kurnool district registered basing on the reports lodged by one Smt. Vadde Varalakshmi, w/o. Vadde Ravi and Smt. Vadde Saritha, w/o. Narasimha Prasad respectively. The petitioner is arrayed as accused No.2 in crime No.11 of 2016. It is his grievance that respondent No.4 is summoning the petitioner and his family members to police station, making them sit for hours together and pressurizing them to compromise the case.

4. Learned Assistant Government Pleader appearing for respondents 1 to 4, on instructions, states that the allegations made in the Writ Petition are all false and that the petitioner shall not be summoned to police station without following due process of law. Recording the said statement, the respondents are directed not to summon the petitioner to police station without following due process of law.

5. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
