THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL APPEAL No.1857 of 2009 JUDGMENT:

This appeal, under Section 378(4) of Cr.P.C., is filed by the appellant-A.P.State Cooperative Bank Limited, challenging the judgment, dated 25.03.2009, passed in C.C.No.138 of 2003, by the II Additional Chief Metropolitan Magistrate, Hyderabad. 2.

During the course of hearing, the learned counsel for the appellant/complainant would submit that the accused have repaid a part of the loan obtained by them. For realising the remaining amount, the appellant/complainant may be given an opportunity to proceed in accordance with law and further contended that the appellant/complainant do not want to prosecute this appeal further. 3.

Under these circumstances, this appeal is dismissed as withdrawn, giving liberty to the appellant/complainant to work out the remedies available to it under law, before the civil Court.
