O R D E R

Aggrieved by the inaction of the respondent - Municipal Corporation is not taking any action for removing the illegal petty shop set up on the open drainage (open nala) and adjacent to the 5th feet width pathway, which is the only way to reach the house of the petitioner and others bearing H.Nos.43-544, 43-5-4-A and 43-5-44a/ 1, situated at Railway New Colony, beside Surya Apartments, Ward No.31, Visakhaptnam in spite of the representations of the petitioner dated 24.10.2016 and 21.11.2016, the present writ petition has been filed.

Heard the counsel for the petitioner and the Standing Counsel for the Municipal Corporation.

On a query by this court, the learned Standing Counsel for the respondent - corporation submitted that no permission has been granted for setting up the said petty shop on the site in question and that appropriate action in accordance with law would be taken. Having regard to the above averments and the submissions of the learned counsel, the writ petition is disposed of at the stage of admission, directing the respondent to take appropriate action in accordance with law on the representations of the petitioner stated to have been made on 24.10.2016 and 21.11.2016, within a period of two weeks from the date of receipt of a copy of this order.

No order as to costs.
