ORDER:

This revision is filed challenging the order of the Court below dated 4.1.2016 in I.A. No. 4 of 2016 in I.A.No.726 of 2015 in O.S. No. 9 of 2011 dated 4.1.2016. I.A. No. 726 of 2015 was filed to reopen the case and to present the defendants to adduce evidence. As petitioners/defendants were not evincing interest to avail opportunity provided, the Interlocutory Application was dismissed. I.A. No. 4 of 2016 is filed praying to restore I.A. No. 726 of 2015. The Court below took note of the conduct of petitioners/ defendants in not prosecuting the matter diligently and seeking to drag on the matter, rejected the prayer in I.A. No. 4 of 2016. The Court below categorically found that conduct of the defendants in proceeding with the matter and taking adjournments time and again would show that defendants are not interested in availing the numerous opportunities provided to them and in proceeding with the trial.

Having regard to the facts narrated in para 3, of the order under challenge, I do not see any error in the order passed by the Court below warranting interference of this Court. The revision fails and accordingly the same is dismissed. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
