HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7881 of 2017 ORDER:
Heard learned counsel for the petitioner/ accused of Crime No.1544 of 2017 of Rajendranagar Police Station, Hyderabad, registered for the offences punishable under Sections 406 and 420 IPC and also learned Public Prosecutor representing the 1st respondent-State before ordering notice to the 2nd respondentdefacto complainant and perused the grounds urged in the quash petition and the contents of FIR.
2) It is one of the contentions of the learned counsel for petitioner that from the FIR allegations, as it is purely a money transaction and offences are breach of trust and cheating, there is nothing to interdict the investigation but for to say pending investigation, petitioner shall not be arrested and secure his presence as and when required.
3) Having regard to the above, the Criminal Petition is disposed of without prejudice to avail all the defences available to the accused.
4) Pending miscellaneous petitions, if any, shall stand closed.
