Smt. Rodha Thachar v. B.Shivakumar , Samuel,
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO Tr.CMP.No.247 of 2018 O R D E R:
Heard counsel for petitioner and counsel for respondent. 2.
Petitioner has filed this petition under Section 24 of CPC seeking transfer of O.P.No.23 of 2018 filed by the respondent against the petitioner from the file of the Family Court, Nalgonda to any Court having jurisdiction to try the same at R.R.District. 3.
It is the contention of the petitioner that petitioner is resident of Vanastalipuram, Hyderabad and that it would be difficult to the petitioner to travel to Nalgonda and there is also a threat to her life.
4.
Counsel for respondent contends that the petitioner had obtained an Aadhaar Card and filed it in the Court below, which discloses that she is a resident of Tipparthy of Nalgonda District and therefore the petitioner would have no difficulty in attending the Court at Nalgonda.
5.
The mere fact that petitioner had obtained an Aadhaar Card when she was resident of Tipparthy at Nalgonda does not mean that the petitioner is bound to stay only at that place and could not have moved to Hyderabad.
Therefore there is no merit in the contention of the respondent.
6.
Since the petitioner is a lady and claims that there is a threat to her life and states that she is a resident of Vanastalipuram at Hyderabad and seeks transfer of the O.P. to a Court having jurisdiction at R.R. District to try the same, the O.P.23 of 2018 on the file of the Judge, Family Court, Nalgonda is withdrawn and transferred to the Family Court, Ranga Reddy District at L.B.Nagar.
7.
Accordingly, this Tr.CMP., is allowed. No order as to costs. 8.
Consequently, Miscellaneous Petitions pending if any, shall stand closed.
