HON'BLE SRI JUSTICE A.RAJASHEKER REDDY Contempt Case No.1026 of 2019 ORDER:

This Contempt Case is filed alleging violation of orders passed by this Court in IA No.1 of 2018 in WP No.44221 of 2018, dated 20.12.2018.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for respondent.

Learned Assistant Government Pleader for respondent produced a copy of proceedings No.B/2525/2019, dated 03.09.2019 stating that in pursuant to the orders passed by this Court on 20.12.2018 in WP No.44221 of 2018, the application of the petitioners was considered and disposed vide proceedings, dated 03.09.2019.

Learned counsel for the petitioners submits that the petitioners were granted pattadar pass books and title deeds and basing on the same, the respondents should have considered the application of the petitioners.

In this case, it is to be seen that the 1st petitioner's daughter filed civil suit before the Principal Junior Civil Judge Court at Bhongir in OS No.376 of 2006 against petitioners and others and obtained preliminary decree and that the petitioners have not disclosed the same while filing the application before the revenue authorities. On that ground, the respondent had disposed of the application of the petitioners stating that the petitioners can approach the authorities after passing of final decree in the aforesaid suit.

In view of the above facts and circumstances, this Court is of the opinion that the respondent has not violated any orders passed by this Court.

Accordingly, this Contempt Case is closed. However, if the petitioners are aggrieved by the proceedings of the respondent, it is open for them to challenge the same, in accordance with law. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
