THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26700 OF 2010 ORDER:
This writ petition is filed challenging the award dated 15.06.2005 passed in ID.No.129/1999 by the Presiding Officer, Labour Court, Guntur, wherein relief was granted in favour of 2nd respondent herein.
When the writ petition came up for hearing on 04.11.2013, this Court passed the following order;
"Learned counsel for the petitioner/s shall take out personal notice to respondent No.2 by registered post with acknowledgment due within a period of four weeks from today, failing which the writ petition against respondent No.2 shall stand dismissed."
For non compliance of the aforesaid order, the writ petition against 2nd respondent was dismissed for default as proof of service of notice is not filed within the time stipulated. Unless the 2nd respondent is a party against whose favour the impugned order passed, no relief can be granted to the petitioner. Accordingly, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
