THE HONOURABLE SRI JUSTICE K.SARATH CRIMINAL PETITION No.6673 of 2025 ORDER:

This Criminal Petition is filed by the petitioner/accused under Sections 480 and 483 of Bharatiya Nagrik Suraksha Sanhita (BNSS) seeking regular bail in Crime No.356 of 2026 of Chaitanyapuri Polcie Station of Rachakonda P.S registered for the 69 and 351 of BNS.

2. The case of the prosecution is that the de facto complainant/LW1 was working as promoter in Hyper Super Market at Kothapet and she got separated from her husband due to disputes. While she was working so, the petitioner, who was also working in the said Super Market, got acquaintance with the de facto complainant and developed intimacy with her and started living together in a rented house in Kothapet, Hyderabad from September, 2022 to June, 2024 and made her pregnant twice and the petitioner got terminated her pregnant by giving tablets. When the de facto complaint asked the petitoner to marry her, he postponed and ultimately the petitoner refused to marry her. Therefore, the de facto complainant gave complaint to the police,

who in turn registered the same as a case in crime No.356 of 2025 for the offence under Section 69 of BNS against the petitioner and took up the investigation. During the course of investigation the accused was arrested on 02.05.2025 and after interrogation the petitioner was remanded to Judicial custody. Hence, the present application is filed seeking release of the petitioner on bail.

3. Heard the learned Counsel for the petitioner/accused and the learned Additional Public Prosecutor appearing for the respondent/State.

Learned counsel for the petitioner submitted that the petitioner is falsely implicated in this case and the relationship between the petitioner and the de facto complainant was purely consensual and there is no material on record to show that the petitioner induced the complainant into such relationship solely under a false promise of marriage at inception. Even according to the complaint, the petitioner and the de facto complainant are having relationship since 2022, whereas the complaint was filed on 16.04.2025 and most of the investigation is completed and therefore requested to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor opposed the bail application on the ground that the allegations leveled against the petitioner are grave in nature and the investigation is still in progress and requested to dismiss the bail application.

Having heard both sides, and on perusing the record, it reveals that the petitioner and the de facto complainant are known to each other since 2022 and were in living relationship for some time and material part of the investigation has also been completed and in Investigation Officers are also cited as LWs.10 and 11 in the remand report.

In view of the same, this Court is inclined to grant bail to the petitioner/accused, subject to the following conditions: (i) The petitioner/accused shall be released on his executing a personal bond for a sum of Rs.25,000/-(Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class-Special (Mobile) PCR Act, Ranga Reddy-cum-IV Addl. Judicial Magistrate of

First Class-cum-IV Additional Junior Civil Judge, Rangareddy District at L.B.Nagar.

(ii) After release, the petitioner/accused shall appear before the concerned S.H.O. on every Sunday between 10.00 am and 11.00 for eight

(8) weeks or till charge sheet is filed, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioner/accused shall abide by the other conditions stipulated in Section 480(3) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
