HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.44163 of 2016 ORDER:

The petitioners state that they are the owners and in peaceful possession and enjoyment of the property situated in various extents of lands in Sy.No.90/1 of Vadlagudam village, Dammapeta Mandal, Khammam District.

When a notice was issued under Section 7 of the A.P. Land Encroachment Act 1905 by the 4th respondent asking the petitioners to file their objections, if any, by appearing before him, the present writ petition is filed.

A perusal of the impugned notice shows that Vadlagudem revenue village is an agency area and the petitioners are non-tribals. However, they state that they will file appropriate objections establishing their long possession and if they are evicted before passing a final order, their interest would be affected. 4.

In the circumstances, this Writ Petition is disposed of directing the 4th respondent not to pass any order of eviction without hearing the petitioners. If the petitioners had not filed their written objections earlier, they shall do so within a period of one week from the date of receipt of a copy of this order. No order as to costs.
