ORDER:
This writ petition is filed for a mandamus to declare the inaction of respondent No.3 in taking action against respondent No.4 for occupying the spaces meant for common usage by the owners and lessors of the commercial complex situated at H.No.16-11-515/1, Dilsukhnagar main road, Hyderabad, as illegal and arbitrary. After arguing the case, Mr.C.Sai Vishnu, learned counsel for the petitioners, requested for permission of the Court to withdraw the writ petition, with liberty to his clients to approach the civil Court for appropriate relief against respondent No.4, who has been allegedly causing obstruction to the occupants of the commercial complex, as it is not within the purview of the Greater Hyderabad Municipal Corporation (GHMC) and its officials to regulate the usage of internal spaces in a building complex by its occupants.
The Writ Petition is, accordingly, dismissed as withdrawn, with liberty to the petitioners in terms of the prayer made. As a sequel to dismissal of the Writ Petition, W.P.M.P.No.55434 of 2015 filed by the petitioners for interim relief shall stand dismissed as infructuous.
