THE HON'BLE SRI JUSTICE MUMMINENI SUDHEER KUMAR WRIT PETITION NO.22100 OF 2022 ORDER:

This Writ Petition is filed seeking a writ of mandamus to declare the action of the respondents in not considering the petitioner's Dharani Application No.2200282467 submitted by the petitioner for mutation of her name in the revenue records in respect of land admeasuring Acs.4.08 gts in survey No.57/A, Laggaon Village, Daheegaon Mandal, Komuram Bheem Asifabad District, as illegal and arbitrary.

Heard Mr. Yadu Krishna Sainath, learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. With their consent, the Writ Petition is disposed of at the stage of admission. 3.

It is contended by the learned counsel for the petitioner that the son of the petitioner by name Narender died and thereafter, the petitioner, being the mother of the said Narender, made an application for succession and mutation of her name in the revenue records in the place of her son in respect of the subject land on Dharani Portal. However, the said application is pending consideration with the respondents and they are not considering the same.

Learned Assistant Government Pleader for Revenue placed before this Court the written instructions received from the third respondent. From the written instructions, it is seen that the petitioner, though made an application on Dharani Portal, she has not produced all the required documents such as death certificate of her son and joint agreement of the legal heirs of the deceased-pattadar etc. Because of the same, the respondents could not take any further action on the application of the petitioner. It is further submitted that besides his mother, the deceased Narender, also has wife and children as legal heirs.

Learned counsel for the petitioner submitted that the petitioner is ready to submit all the documents concerned, as required by the respondents and seeks indulgence of this Court to direct the respondents to dispose of the said application, which is pending before them, in accordance with law. 6.

Taking into consideration the facts and circumstances of the case, this Writ Petition is disposed of giving liberty to the petitioner to upload the required documents such as death certificate of Narender and joint memo of all the legal heirs on the Dharani Portal and on uploading of the said documents by the petitioner, the second respondent is directed to consider the

MSK,J W.P.NO.22100 OF 2022 said application No.2200282467 submitted by the petitioner and dispose of the same in accordance with law within a period of eight (8) weeks from the date of uploading of the documents concerned by the petitioner. It is needless to observe that the second respondent, before taking any decision on the application submitted by the petitioner, shall put all the legal heirs of the deceased Narender, on notice.
