The Management Of Express Publications(Madurai) Ltd., v. The Authority Under The Payment Of Wages Act And Joint
MSRJ W.P.No.20296 of 2017 HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.20296 of 2017 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Labour appearing for 1st respondent. 2.
This Writ Petition is filed challenging the order passed by 1st respondent in I.A.No.7 of 2014 in P.W.1 of 2012 on 22-12-2017 deciding a preliminary issue against the petitioner regarding maintainability of the application filed by respondent Nos.2 to 9 before 1st respondent and holding that their application is maintainable.
3.
Though learned counsel for the petitioner sought to contend that this order is erroneous, having regard to the fact that already five years have elapsed since the filing of the case before 1st respondent by respondent Nos.2 to 9, and entertaining the Writ Petition at this stage would further delay disposal of the matter, I am not inclined to exercise jurisdiction under Article 226 of the Constitution of India at this stage.
4.
Therefore, the Writ Petition is dismissed at the admission stage granting liberty to the petitioner to raise this issue also along with any other issues, if the petitioner feels aggrieved by the final order which might be passed by 1st respondent in the said case. No costs.
MSRJ W.P.No.20296 of 2017 5.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
