THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2743 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.190 of 2015 on the file of the Judicial Magistrate of First Class, Mylavaram, arising out of offences under Section 324 IPC read with Section 34 IPC.

Heard and perused the material available on record. Learned counsel for the petitioners after arguing for some time, confined his arguments with regard to dispensing with the presence of the petitioners herein.

Considering the same, the presence of the second petitioner, being the lady and the allegations against the third petitioner are not so serious in nature, and also as the question of their identity does not arise, the presence of the second and third petitioners is dispensed with except on the dates when the trial Court insists for their appearance. However, the presence of first petitioner is not dispensed with and as such, he is directed to appear before the Court below on all hearing dates.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 08.03.2016 pln
