HONOURABLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No. 11768 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C.

seeking release of the Tractor bearing temporary Registration No.AP24UB TR 0964 and Trailer bearing temporary registration No.TS05M TR 8216 seized in connection with Cr.No.176 of 2016 on the file of the Station House Officer, Police Station, Devarakonda, Nalgonda District, by permitting the petitioner to furnish the third party Surety before the learned Judicial First Class Magistrate, Devarakonda, Nalgonda district.

The petitioner who claims to be the owner of the aforesaid Tractor and Trailer submits that he has purchased the said vehicle from its original owner on 13.11.2015 and that the registration of the aforesaid vehicle in his favour is pending with the RTA officials.

Since the vehicle stands in the name of Simarla Niranjan and the said vehicle is not yet transferred in the name of the petitioner, the present Criminal Petition is disposed of directing the petitioner to get the aforesaid vehicle transferred in his name and move the Court below seeking interim custody of the vehicle in question. As and when the petitioner files application seeking interim custody of the vehicle, the Court below shall consider the

same and pass appropriate orders for release of the vehicle subject to the condition of executing bond for Rs.5,00,000/- (Rupees five lakh only ) with one surety for the like sum to the satisfaction of the Court below. Further the petitioner shall give an undertaking before the Court below that he shall not put the vehicle to any use other than his personal use, shall not sell or otherwise dispose of or alienate the vehicle or create any third party right until disposal of the main case.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
