HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4748 OF 2017 ORDER:

The case of the petitioner is that he was issued notice dated 30.12.2016 vide proceedings in R.C.No.B/3760/2016 under Section 7 of the Land Encroachment Act, 1905, which was served on the petitioner on 02.02.2017. Pursuant to the said notice, the petitioner submitted his explanation on 03.02.2017. But without passing any orders, the respondents are trying to evict the petitioners. Aggrieved by the same, the present writ petition is filed. Heard both sides.

In view of the above facts and circumstances, the 3rd respondent is directed to pass final orders in pursuant to the impugned notice dated 30.12.2016 after considering the explanation of the petitioner and after giving opportunity of hearing to the petitioner. Till passing of final orders, status-quo obtaining as on today shall be maintained by both the parites. With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
