THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.4597 of 2015 ORDER:

This petition is filed under Section 438 Cr.P.C. seeking anticipatory bail by the petitioner/accused No.1 in Cr.No.25 of 2015 on the file of Badvel Urban Police Station, YSR Kadapa district registered for the offences punishable under Sections 420, 494, 307 and 506 r/w 34 of IPC. The de-facto complainant is none other than the wife of the petitioner. As per the allegations made in the complaint, the petitioner /A.1 at the instance of the other accused married one K. Sravanthi while his marriage with the de-facto complainant is in subsistence. It is further alleged that on 03.02.2015, the petitioner along with the other accused made an attempt to kill the de-facto complainant and threatened her with dire consequences. The First Additional Sessions Judge, Kadapa dismissed the anticipatory bail petition filed by the petitioner on 07.05.

2015 vide Crl.M.P.No.596 of 2015. Heard the learned counsel for the petitioner and the learned Public Prosecutor. The petitioner is none other than the husband of the de-facto complainant. It appears that bad weather prevailed in the family life of the petitioner and the defacto complainant. Even as per the case of the prosecution, the petitioner has been working as teacher in government school. If the police apprehend the petitioner, the petitioner has to face far reaching consequences. Taking into consideration the nature of allegations made in the complaint as well as the nature of the employment of the petitioner, I am of the considered view that this is a fit case to grant anticipatory bail to the petitioner/ A.1. In the result, the petition is allowed, granting anticipatory bail to the petitioner on the following conditions.

The Station House Officer, Badvel Urban Police Station, YSR Kadapa district is hereby directed to release the petitioner / accused No.1 on bail in the event of his arrest in Cr.No.25 of 2015 on his furnishing self bond for Rs.20,000/- (Rupees Twenty Thousand

only) with two sureties for a likesum each to his satisfaction, 2.

The petitioner shall make himself available for interrogation by a police officer as and when required, 3.

The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or to any police officer 4.
