THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 18434 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home.

Since this Court is not adjudicating the matter on merits, it may not be necessary to issue notices to the unofficial respondent. The present writ petition is filed with the following prayer: 'For the reasons stated in the accompanying affidavit, the petitioner herein prays that the Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondent Nos.2 to 5 in not arresting respondent No.6 for the cognizable offences punishable under Sections 448, 427, 506 (ii) read with Section 34 of IPC and for not investigating further in view of the petitioner complaint is arbitrary, illegal, capricious and opposed to Sections 154 to 161. Consequently direct respondent Nos.

3 to 5 to investigate further and submit report to the judicial First Class Magistrate, in the interest of justice and pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case.' At the time of argument, learned counsel for the petitioner submits that though the crime was registered against the petitioner, the police authorities are not arresting the sixth respondent and investigating the case. Therefore, he seeks a direction to be given to the police to complete the investigation at the earliest and file a final report.

Learned Government Pleader submits that since crime was registered only on 04.04.2016 and having regard to the nature of allegations made, it may not be possible to file a final report

immediately.

Having regard to the circumstances stated above, the present Writ Petition is disposed of directing the fifth respondent to file a final report in Crime No.100 of 2016 of Airport Police Station, Visakhapatnam, in accordance with law, as early as possible, preferably within a period of 5 to 6 months.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. ______________________ JUSTICE C.PRAVEEN KUMAR 14.06.2016, vhb
