THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40047 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in registering Crime No.509 of 2016, dated 21.10.2016, as illegal and arbitrary. The grievance of the petitioner is that the 4th respondent has lodged the present complaint against the petitioner alleging that the petitioner and others tried to trespass into his land admeasuring Ac. 00.24 guntas forming part of Survey No.222 of Gajularamam Village, Qutbullahpur Mandal, R.R. District and that the said property was purchased by him through a registered Sale Deed vide Document No.2818 of 2003, dated 05.03.2003. Based on the complaint, the 3rd respondent registered the same as Crime No.509 of 2016, dated 21.10.

2016, for the offences punishable under Sections 468, 471, 420 IPC without there being any involvement of the petitioner. Considering the grievance of the petitioner and since the petitioner is aged about 82 years, the 3rd respondent is directed to complete the investigation in Crime No.509 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 21st November, 2016 KL
