This Writ Petition is filed for a Mandamus to declare the action of respondent No.3, in giving oral instructions to the petitionerGram Panchayat to keep the balance amount derived from conducting shandy with it, as illegal. The petitioner sought for a consequential direction to respondent No.3 to permit the petitioner to deposit the balance amount available with it after conducting shandy in the Government Treasury as per Resolution, dated 06-01-2014.

At the hearing Mr.M.V.Suresh, learned Counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition with liberty to the petitioner to file a fresh Writ Petition through the Panchayat Secretary instead of the Sarpanch.

The request of the learned Counsel for the petitioner is accepted and the Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.

As a sequel to dismissal of the Writ Petition, WPMP.No.44498 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous.
