On 28.04.2014, it was represented that the learned counsel for the petitioner died. Hence, notice was ordered to be issued to the petitioner, pursuant to which, notice was issued to the petitioner on 14.05.2014, which was returned un-served with an endorsement "party expired". Therefore, the matter is listed today under the caption "For orders of the Court". When the matter is called today, there is no representation on behalf of the legal representatives of the deceased petitioner. Even otherwise, it is to be noted that the writ petition was filed to declare the action of the respondents in not promoting the petitioner as Junior Assistant, though his juniors were promoted. The writ petition was filed in the year 2000 and no interim order was passed, while admitting the writ petition. Meanwhile, the petitioner died and the legal representatives did not take steps to pursue the matter. Hence, the Writ Petition is dismissed for non-prosecution. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in the writ petition shall also stand dismissed.
