Heard learned counsel for the petitioners and learned Government Pleaders for Revenue and Irrigation. 2.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not considering the representation dated 16.07.2012, made by the petitioners to the second respondent seeking protection of the bund of Damodarsagaram Minor Irrigation Tank situated in V.G.Puram, Puchapadu, Daboro, Mandasa Mandal, Srikakulam District, as illegal and arbitrary.

Learned counsel for the petitioners submits that though the representation was made in the year 2012, the same is kept pending till date.

Learned Government Pleader for Revenue submits that the said representation may be directed to the disposed of, provided the same is kept pending. He further submits that the Executive Engineer, Irrigation Department is the appropriate authority to consider the said representation.

Having regard to the above submissions, the petitioners are directed to make a fresh representation before respondent No.4-

Executive Engineer, seeking protection of bund of Damodarsagaram Minor Irrigation Tank, in which event, the same shall be dealt with, in accordance with law, after giving notice and after hearing both the parties, including aggrieved persons, if any. 7.

With the above direction, the writ petition is disposed of. 8.
