THE HON'BLE SRI JUSTICE R.SUBHASH REDDY CIVIL REVISION PETITION No.4595 of 2015 ORDER:

This Civil Revision Petition, under Section 115 of C.P.C., is filed against the notice, dated 26.08.2015, issued in E.P.No.324 of 2013 in O.S.No.2486 of 2011 on the file of V-Senior Civil Judge, City Civil Court, Hyderabad.

Heard learned counsel for the petitioners and perused the impugned order and other material available on record. The petitioners herein are the judgment-debtor Nos.1 and 2 and respondent No.1 herein is the decree-holder in the aforesaid E.P. The impugned order is only a notice in the E.P filed by the decreeholder for arrest and imprisonment of the judgment-debtors in Civil prison for non-compliance of the decree. As the impugned order is only a show-cause notice in E.P proceedings, if the judgment debtors have any objections thereto, they can as well raise the same before the Executing Court by way of filing counter in the E.P. Hence, this Court does not find any reason to interfere with the impugned order at this stage.

Accordingly, the Civil Revision Petition is dismissed. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
