THE HONOURABLE SRI JUSTICE K.SARATH CRIMINAL PETITION No. 6690 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short 'BNSS') seeking anticipatory bail to the petitioner/accused No.3 in Crime No.79 of 2025 on the file of Abids Police Station, Hyderabad District, registered for the offences punishable under Sections 109, 352, 115(2) r/w 3(5) of Bharatiya Nyaya Sanhita (BNS) .

The case of the prosecution is that on 03.04.2024, de facto complainant/respondent No.2 lodged a complaint against the petitioner/accused No.3 and other accused stating that they have quarreled with him using filthy language. The complainant further stated that accused No.1 stabbed him and some other accused have assaulted him with hands. Later when some other persons arrived at the spot, the accused fled away from the spot. Hence, he requested to take necessary action.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent No.1-State. 4.

Learned counsel for the petitioner submits that accused No.1 filed Crl.P.No.5249 of 2025 before this Court to quash the proceedings

against him in Crime No.79 of 2025. While the case was pending, the complainant and accused No.1 entered into compromise and pursuant to that, the complainant filed permission and compromise petitions vide I.A.Nos.2 and 3 of 2025 in Crl.P.No.5249 of 2025 before this Court and this Court allowed both the petitions and also allowed the criminal petition on 01.05.2025, by quashing the proceedings against accused No.1 in Crime.No.79 of 2025. Therefore, petitioner/accused No.3 is entitled for grant of anticipatory bail.

Learned Additional Public Prosecutor does not dispute with regard to the quashment of proceedings of Crime No.79 of 2025 against the accused No.1 in Crl.P.No.5249 of 2025 dated 01.05.2025. 6.

Having considered the submissions made by the respective parties and after perusal of the material available on record, this Court deems it fit to grant anticipatory bail to the petitioner/accused No.3. 7.

Taking into consideration of the above facts, this Court is of the considered view that petitioner/accused No.3 is entitled for grant of anticipatory bail, subject to the following conditions:

1. The petitioner/accused No.3 shall surrender before the Station House Officer of Abids Police Station, Hyderabad District, on or before 11.06.2025, and on such surrender, the said Station House Officer shall release the

petitioner/accused No.3 on bail on his executing a personal bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the like sum each to the satisfaction of the said Station House Officer.

2. The petitioner/accused No.3 shall abide by the other conditions stipulated in Section 482 (2) Bharatiya Nagarik Suraksha Sanhitha, 2023 and co-operate with the Investigating Officer in investigation of the case. 8.
