THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.18336 of 2006 ORDER:

This writ petition filed under Article 226 of the Constitution of India challenges the Memo Rc.No.2080/2006/TRI/VC-2 dated 29.7.2006 issued by the 2nd respondent-Director of Tribal Welfare, A.P., Hyderabad. By virtue of the said memo, a seat in Engineering was asked to be kept in abeyance.

This Court, while ordering rule nisi on 11.9.2006, granted interim order in W.P.M.P.No.230430 of 2006, which reads as under: "Notice. Post after two weeks. Pending further orders, there shall be interim direction as prayed for. However, it is made clear that the admission given to the petitioner shall be provisional in terms of Rule 19 of the Andhra Pradesh (SC, ST & BCs) Regulation of Issue of Community, Nativity and Date of Birth Certificate Rules, 1997 and the same shall be subject to further orders in this writ petition".

Heard the learned counsel for petitioner and Sri V.Ramachander Goud, learned counsel appearing for 1st respondent apart from perusing the material available on record.

It is submitted that pursuant to the interim orders granted by this Court on 11.9.2006, petitioner's son completed the B.Tech. course. In view of the said development, this writ petition stands disposed of, keeping it open to the respondent authorities to proceed in accordance with the provisions of Act 16/93 and enquire into the matter, if they are advised to do so, with regard to the caste status of the petitioner's son. The writ petition is accordingly disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
