HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5389 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/ accused under Section 482 Cr.P.C seeking to quash the proceedings in C.C No.26 of 2015 on the file of II Additional Chief Metropolitan Magistrate, Vijayawada, registered for the offences punishable under Sections 498-A IPC and Section 4 of Dowry Prohibition Act.

2) Heard learned counsel for the petitioner/ accused as well as learned public prosecutor representing 2nd respondent-State before admission and before ordering notice to 1st respondent. Perused the material on record.

3) In the course of hearing, it is submitted by learned counsel for petitioner that as the calendar case No.26 of 2015 pending on the file of II Additional Chief Metropolitan Magistrate at Vijayawada, the learned trial Judge is directed to hear on charges and in the event of framing of any charges and no material to discharge, to conduct trial and give early disposal of the case.

4) Having regard to the above, the application is disposed of giving liberty to file any application under Section 239 Cr.P.C for any ground to discharge and if no grounds to discharge and any charges framed on examination the trial shall be conducted preferably day-to-

day on quick disposal within three months from the date of receipt of a copy of the order.

5 ) Miscellaneous petitions, if any pending, shall stand closed.
