HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.13773 of 2018 ORDER: (Oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) Petitioner has filed the present writ petition with the prayer, which reads as under :

"to grant appropriate relief more in the nature of Writ of Mandamus under Article 226/ 227 of the Constitution of India declaring the Charge Memo No 246/E1/2015 dt 10012018 issued by the 1st Respondent as arbitrary illegal malafide discriminatory and unconstitutional violating Article 14 16 and 21 of the Constitution of India apart from contrary to Rule20 of AOCS CC and A Rules as well as against the principle of natural justice and contrary to the principle laid down by the Honble Supreme Court in case of Anant R Kulkarni v Y P Educational society and others reported in 2013 indlaw sc 268 2013 6 scc 515 and set aside the same including the orders of the Honble Tribunal dt 27 02 2018 passed in OA No 360/2018 and issue consequential direction directing the Respondents to forthwith consider and promote the Petitioner to the post of Additional Project Director against the vacancies earmarked for schedule tribe as well as schedule tribe women as per roster points prescribed under Rule22 of AP State and Subordinate Service Rules."

It is not in dispute that the case of the petitioner comes within the ambit of G.O.Ms.No.257, dated 10.06.1999.

Accordingly, we hereby dispose of the present writ petition directing the respondents to consider the petitioner's candidature in accordance with the provisions of the aforesaid G.O., if promotions are taken up to the post of Additional Project Director. No order as to costs.
