HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.C.M.P.No.238 of 2014 ORDER:

This petition is filed to withdraw O.P.No.46 of 2013 from the file of Senior Civil Judge, Nellore and transfer the same to Family Court, Ranga Reddy District at L.B. Nagar.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 31.08.2007 at Kukatpally, Hyderabad, as per Hindu rites and caste custom and that she is working as Lecturer in Word & Deed India Junior college, Hayathnagar since 2005 and due to the behaviour and attitude of respondent she was left at her parents house on 02.11.2011 without any cause and since then she is staying there and she lodged a complaint with Station House Officer, Women's Police Station, Saroornagar, Cyberabad, which is registered as Crime No.46 of 2013 and thereafter she received summons in HMOP from Senior Civil Judge court, Nellore filed by respondent seeking dissolution of marriage. She stated that the above O.P.

is filed deliberately only to harass her and make her to go all the way to Nellore from Hyderabad to take vengeance against her. She further stated that there is a life threat to her at Nellore and as she is working as Lecturer at Hayathnagar, it will be difficult for her to travel all the way from Hyderabad to Nellore. For these reasons, she prayed for transfer of OP from Senior Civil Judge, Nellore to Family Court, Ranga Reddy.

3. On 18.04.2016, this Court permitted the advocate for petitioner to take out personal notice through his advocate on record in the lower Court by registered post with acknowledgement

due and file proof of service. In compliance of the said order, advocate for petitioner filed Memo stating that notice sent to advocate on record was duly served on 06.06.2016. Along with memo, he filed postal receipt and postal acknowledgment.

4. In spite of service of notice respondent neither appeared in person nor through any advocate.

5. Heard arguments.

6. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.46 of 2013 is withdrawn from the file of Senior Civil Judge, Nellore and transferred to Family Court, Ranga Reddy District at L.B. Nagar for disposal in accordance with law.

7. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, pending in this petition, if any, shall stand closed.
