HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION Nos.19842 and 19852 of 2011 COMMON ORDER:

Since the issue involved in both the writ petitions is one and the same, these writ petitions are heard together and are being disposed of by this common order.

The above writ petitions are filed seeking to declare the action of the respondents in giving a marking at the shops of the petitioners situated at Kurnool road of Ongole Town, Prakasam District, for the purpose of road widening, without following the due process of law, as illegal and arbitrary, and consequently, to direct the respondents not to demolish the shops of the petitioners.

Heard and perused the material available on record. 4.

The main grievance of the petitioners is that the respondents are trying to demolish the shops or structures belonging to the petitioners for the purpose of road widening, as per the marking given by the 2nd respondent in Kurnool Road, without following due process of law. 5.

Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on the merits, this Court is inclined to pass the following order: "The respondents are directed not to demolish the shops or any structures belonging to the petitioners at Kurnool Road, Ongole Town, Prakasam District, without following the due process of law."

With the above direction, the Writ Petitions are disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
