HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11506 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the show cause notice cum suspension order dated 31.03.2015 issued by the 3rd respondent in suspending the F.P. shop authorisation of petitioner, as illegal and arbitrary.

3 . The petitioner's fair price shop No.30, Mayadarlapalli Village, Kundurpi Mandal, Anantapur District, was allegedly inspected by the authorities and certain variations have been noticed. This apart, some other irregularities have also been noticed as pointed out in the show cause notice cum suspension order. Learned counsel appearing for the petitioner submits that the shop of the petitioner was not at all inspected and only with a view to remove the petitioner from out of the dealership of the fair price shop, the impugned order was passed.

4. In any event as can be seen from the impugned order, the variations of rice and kerosene in the stock are not within permissible limits and a detailed enquiry has to be conducted. Under these circumstances, the 3rd respondent-Revenue Divisional Officer, Kalyandurgam, Anantapur District, is directed to conduct enquiry against the petitioner and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of at the stage of admission. Miscellaneous applications, if any, in this writ petition, shall stand closed. No order as to costs.
