THE HONOURABLE SMT JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION NO. 4145 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/Accused No.2 in the event of his arrest in connection with Crime No.96 of 2022 on the file of Station House Officer, Midjil Police Station, Mahabubnagar District registered for the offence punishable under Section 307 IPC read with Section 34 of Indian Penal Code (IPC).

Heard the learned counsel for the petitioner/Accused No.2 and the learned Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that the petitioner herein is the son of Accused No.1 in the said crime. A.1 was already arrested and was enlarged on bail. As seen from the FIR, there was a quarrel between A.1, A.2 and the de facto complainant with regard to the land. The petitioner herein is also injured in the said quarrel.

Learned Public Prosecutor submits that most of the investigation is completed in this case.

Having regard to the above facts and as most of the investigation is completed, this Court is inclined to grant Anticipatory Bail to the petitioner/Accused No.2. 6.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.2 shall be enlarged on bail subject to the following conditions:

i) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Midjil Police Station, Mahabubnagar District, within a period of ten (10) days from today and on such surrender, the petitioner/Accused No.2 shall be enlarged on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties each to the like sum to the satisfaction of Station House Officer, Midjil Police Station, Mahabubnagar District. The petitioner/Accused No.2 shall appear before the concerned police station on every Sunday between 10.00 a.m., and 2.00 p.m., for a period of two months or till filing of charge sheet whichever is earlier.

ii) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C. Miscellaneous applications, if any pending, shall stand closed.
