THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23265 of 2002 ORDER:

This Writ Petition is filed challenging the action of the respondents in recovering the amounts from the petitioner with the loan obtained by the 4th respondent.

It is submitted by the petitioner that the 4th respondent has obtained loan and petitioner was a guarantor. Since the 4th respondent has not paid the loan amount, the respondents are recovering the amount from the petitioner as he being a guarantor. 3.

This Court, having considered the said submissions made by the petitioner, is the considered view that the as the petitioner is guarantor to the loan obtained by the 4th respondent, he is bound to repay the amounts to the respondents. In view of the same, there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
